1. Overview
This website is operated by Karbon Copy LLC, a California limited liability company doing business as 8PE Wear (collectively, "8PE Wear," "we," "us," or "our"). These Terms of Service govern your use of 8pewear.com and your purchase of products or services through the site. By accessing the site or placing an order, you agree to these Terms and to the policies linked from the site, including our Privacy Policy, Shipping Policy, and Refund Policy.
If you do not agree to these Terms, do not use the site or place an order.
2. Eligibility and account responsibility
You must be legally capable of entering a binding agreement in your jurisdiction to place an order. If you create a customer account, you are responsible for keeping your login information secure and for activity conducted through your account. Information you provide must be current, complete, and accurate.
3. Products and made-to-order production
Many 8PE Wear products are produced or decorated after an order is placed. Product colors, texture, print appearance, embroidery, and placement may vary slightly from on-screen previews because of garment construction, production methods, screen settings, and normal manufacturing tolerances.
We make reasonable efforts to display products accurately, but digital mockups and photographs are illustrative. Product availability, colors, sizes, descriptions, and pricing may change without notice.
4. Orders, acceptance, and cancellation
Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, payment problems, shipping restrictions, or production limitations.
Because production may begin shortly after an order is submitted, changes and cancellations are not guaranteed. Contact hello@8pewear.com as soon as possible if you need assistance. If we cancel an item or order after payment, we will issue the applicable refund to the original payment method.
5. Pricing and payment
Prices are displayed in the currency shown at checkout and may change without notice. Applicable shipping, taxes, duties, and other charges are shown or calculated during checkout when available. You authorize us and our payment providers to charge the payment method you submit for the full order total.
Discounts and promotional offers may have separate conditions, expiration dates, exclusions, or usage limits. Unless expressly stated, offers cannot be combined, transferred, redeemed for cash, or applied retroactively.
6. Shipping and delivery
Products may be fulfilled by third-party production partners and may ship separately. Production and delivery dates are estimates, not guarantees. Carrier delays, weather, holidays, customs, inventory changes, address problems, and other events outside our reasonable control can affect delivery.
Customers are responsible for providing a complete and accurate delivery address. Review our Shipping Policy for current fulfillment and tracking information.
7. Returns, replacements, and refunds
Because products are made to order, eligibility for returns, exchanges, replacements, and refunds is governed by our published Refund Policy. If an item arrives damaged, defective, or materially different from the order, contact hello@8pewear.com within the period stated in that policy and include the order number and requested photographs.
Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.
8. Care, fit, and sizing
Customers are responsible for reviewing available size guides, product descriptions, and care instructions before ordering. Fit can differ between garment styles and manufacturers. Damage caused by use, misuse, alteration, or care that conflicts with the provided instructions may not qualify for replacement or refund except where required by law.
9. Intellectual property
The site and its content—including the 8PE Wear name, 8PE branding, artwork, logos, designs, text, photographs, graphics, video, audio, layouts, and product names—are owned by or licensed to Karbon Copy LLC, doing business as 8PE Wear, and are protected by applicable intellectual-property laws.
You may use the site for personal, noncommercial shopping. You may not reproduce, modify, distribute, sell, license, scrape, exploit, or create derivative commercial works from our content without prior written permission.
10. Reviews, submissions, and user content
If you submit a review, photograph, comment, idea, or other content, you represent that you have the right to submit it and that it does not violate another person's rights or applicable law. You grant 8PE Wear a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the business, subject to applicable privacy law.
We may remove content that is unlawful, deceptive, abusive, infringing, or otherwise inappropriate.
11. Prohibited uses
You may not use the site to commit unlawful or fraudulent acts; infringe intellectual-property or privacy rights; transmit malicious code; interfere with site security or operation; collect information without authorization; impersonate another person; submit false payment or delivery information; or attempt to evade purchase limits or access restrictions.
12. Third-party services and links
The site may rely on or link to services operated by Shopify, payment providers, fulfillment partners, carriers, social platforms, and other third parties. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party sites or services outside our reasonable control.
13. Disclaimer of warranties
To the maximum extent permitted by law, the site and services are provided on an "as available" basis. We do not promise that access will always be uninterrupted, secure, or error-free. Any warranties that cannot legally be excluded remain in effect.
14. Limitation of liability
To the maximum extent permitted by law, Karbon Copy LLC, doing business as 8PE Wear, and its owners, personnel, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the site, products, or services.
Where liability cannot be excluded, our aggregate liability will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold Karbon Copy LLC, doing business as 8PE Wear, harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the site, your violation of these Terms, or your infringement of another party's rights.
16. Termination
We may suspend or terminate access to the site if we reasonably believe these Terms have been violated or site security, customers, or the business are at risk. Provisions that by their nature should survive termination will remain effective.
17. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise. Any required venue or dispute language should be reviewed for the jurisdictions in which 8PE Wear operates.
18. Changes to these Terms
We may update these Terms to reflect changes in our operations, products, services, or legal obligations. The revised version becomes effective when published with an updated revision date. Continued use of the site after publication constitutes acceptance where permitted by law.
